France Travel (the Service Provider) organizes and markets passenger transportation services with driver as part of leisure or business trips in Europe.
The following Terms of Sales apply, to the exclusion of all other conditions, to all services offered by France Travel to its clients and are available at any time on the website www.france-travel.eu. They will prevail, where applicable, over any other version or any other contradictory document.
These Terms are subject to change at any time. The applicable version is the one featured on the website on the date of reservation. Modifications to the Terms of Sale shall be legally enforceable to uses of www.france-travel.eu as from the moment they are published online.
ARTICLE 1 – ACCEPTANCE OF THE TERMS OF SALES
By purchasing any service of France Travel, the Client accepts and agrees to these Terms of Sale in full.
ARTICLE 2 – ELIGIBILITY
The Client warrants being eligible for booking any of France Travel services in accordance with all terms and conditions herein, which means being of legal age as defined by the host country, being legally capable of contracting and not being under supervision or curatorship. Reservations must be made by the Client or by a duly authorized representative. The Client guarantees that all information supplied is true and accurate.
At the time of booking, the Client must inform France Travel of the age of children included in his reservation as well as of any particularity related to the possible incapacity (physical or mental) of a traveller, so that the France Travel team can ensure to welcome all clients in the best and most appropriate conditions. France Travel reserves the right to refuse any special request that may not comply with the standards and regulations in force. In any case, France Travel cannot be held responsible for any disagreement that may result from a lack of information from the Client.
ARTICLE 3 – RESERVATION
The Client can book either directly on www.france-travel.eu, or by phone on +33 6 44 86 82 51 or email on contact@france-travel.eu.
Every transportation service must be booked no later than 24 hours before the start of the said service.
Booking confirmation : the Client receives an automatic confirmation of reservation by e-mail and it is the Client’s responsibility to check that the received information on the booking confirmation is correct. Only this written information will prevail in the event of disagreement.
ARTICLE 4 – PRICES AND PAYMENT
All prices are displayed in Euros and include all taxes. Services are charged at the prices published and taxes in force at the time when the reservation was made.
Applicable prices vary depending on the distance, the length of the service or the level of difficulty of the route taken.
Prices are those indicated on the website on the date of the reservation. France Travel can modify the price of transportation services at any time. The change will then be notified to the Client before confirming any new reservation. These prices are contractual rates.
No dispute related to the price of a service can therefore be taken into account once the booking confirmation is effective.
These prices are reserved for “individual persons” aged at least eighteen (18) years old and with full legal capacity to book a service whether online or directly.
_The following are included in the service:
the vehicle used for the client’s transportation,
the provision of a driver speaking at least in French and English,
professional insurance for paying passengers,
the kilometres travelled or the hours operated,
vehicle maintenance, fuel, the cost of tolls and all parking places,
the duration of the service as determined at the time of booking,
transportation of the Client’s luggage, within the capacity limit of the vehicle.
_The following are not included in the service:
entrance fees to activities sites (airport, museums, theatres, castles, stadium or others),
entrance fees to public places,
transport price for a service of either a longer distance or duration than the one originally booked,
accommodation and meal costs,
personal expenses.
Payment methods (internet reservation): the Client can book in advance for the service reserved either by credit card, via Paypal or by bank transfer.
Reservations made within 48 hours of the service starting date must be paid in full by credit card.
Late payment or non-payment : in the event that the Client fails to pay for the service booked before its start date, France Travel is forced to cancel the service.
ARTICLE 5 – CANCELLATION / MODIFICATION
Either parties cannot be held responsible in the event of delay or non-performance of the contract as a result of a case of force majeure or unforeseen circumstances, due to the other party or a third party or external causes such as public order disturbances, strikes or labor disputes, intervention of the civil or military authorities, terrorist attacks, natural disasters, fire and explosions, floods or disruption of the telecommunications network.
_Requested by the Client:
Any cancellation of a service booked must be notified in writing to France Travel on contact@france-travel.eu at least 48 hours before the start date of the said service. The Client will then be refunded within 7 working days, excluding an amount equivalent to 5% of the total amount paid in order to cover for banking services cost.
Shall the cancellation request arise later than 48 hours, a payment of 50% of the total amount of the service may be requested.
Any cancellation of reservation less than 24 hours before the start date of the service will be considered as due and charged to the Client.
Any service started is due. The Client is free to leave or interrupt the service at any time ; no refund or discount will then be possible.
Any modification of the journey by the Client must be reported to France Travel as soon as possible in order to ensure the best quality of transportation service. This change may result in supplement fares, or even cancellation if the Service Provider is then unable to deliver its services to its clientele. Any change in the route or stop during the transportation service may imply additional charges.
_Requested by the Service Provider:
France Travel reserves the right to cancel or suspend a reservation in the event of sick leave of the driver or in the event of force majeure: bad weather conditions, pandemic, strike, accident, terrorist acts, etc. If applicable, France Travel will proceed to a full refund.
In the event of cancellation of a reservation, the Service Provider will inform the Client by email and, if possible, will first offer to postpone the service to another date.
France Travel reserves the right to cancel or refuse any reservation made by a Client with whom there may be a dispute in regards to payment of a previous purchase.
ARTICLE 6 – SERVICE PROVIDER’S OBLIGATIONS
France Travel undertakes to provide a vehicle in perfect working order as well as in clean and safe conditions. In the event that the vehicle is disabled due to mechanical failure, accident, theft or damage (theft, damage), the Service Provider will endeavour to ensure and continue the transportation service in the best possible conditions.
ARTICLE 7 – CLIENT’S OBLIGATIONS
The Client must be present at the agreed time for the start of the transportation service and must show up to the meeting point by his own means.
The Client agrees to leave the vehicle in similar conditions along the duration of the service. In case of any damage caused by the Client or its accompanying passengers, France Travel reserves the right to charge the Client as compensation for the cost and expenses of clean-up and repairs after notification to the ‘paying’ Client, including a picture as proof.
The Client shall take out civil liability insurance which may be incurred in the event of damage.
ARTICLE 8 – THE TRANSPORTATION SERVICE
The service provided by France Travel is regulated by articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the Tourism Code and consist in providing the Client with a vehicle always with the joint services of a driver.
The service begins at the place where the vehicle is parked or at the place agreed for the start of the journey, on the day and time set in the contract previously established between the parties at the time of booking. The service ends on the day and time the vehicle returns to its place of departure or otherwise agreed.
Any service started is due.
Transfer services :
In the event that the Client cannot find the driver, he must immediately contact France Travel by phone on +33 6 44 86 82 51 to avoid being charged the full amount of the service.
In the event of late arrival of the Client, the driver will contact the client and shall wait 15 minutes at the pick-up location. After this period and with no news from the Client, France Travel will consider the service cancelled and the CLient will be charged in full without any refund.
Insurance – Every driver provided by France Travel is legally placed upon insurance covering all risks related to its business as well as covering passengers, from getting in until getting out of the vehicle. This includes bodily, material, and immaterial damage they could suffer from as a result of a traffic accident, except in case the damage was caused by their own fault or in case of force majeure.
Luggage – Luggage remains under passenger’s supervision and responsibility throughout the service. France Travel is in no way responsible for items left in vehicles or elsewhere during a journey.
Equipment care – Any damage caused by the Client to France Travel’s equipment, including any damage to the interior of any vehicle, will be charged to the client.
Wearing a seat belt is compulsory both at the front and at the rear of the vehicle.
Smoking is strictly prohibited inside the vehicle.
Animals – Animals are not allowed in vehicles.
Coverage limits
France Travel reserves the right to refuse or interrupt a journey on the spot, in any of the following situation:
_ The physical or mental state of a passenger, including as a result of alcohol, drugs or medication consumption, could present a danger or even a risk for himself, the driver or the other passengers.
_ Transportation of one of the passengers and / or his baggage could disrupt the in-vehicle safety, health, cleanliness or good travel conditions, especially if the passenger intimidates, misbehaves or uses abusive and / or insulting language towards the driver.
The service will then be invoiced in full to the Client.
The Client may not, and under any circumstances, ask for the driver to exceed the authorized speed limit or to commit any traffic violation.
More generally, the driver reserves the right to refuse any Client request that he considers likely to compromise the safety of vehicle occupants and other road users. France Travel drivers are true professionals, they are responsible and must abide by applicable laws.
France Travel cannot, under any circumstances, be held responsible for any delays by the driver or the arrival of the Client to the final destination due to cases of force majeure related to transport such as: heavy road traffic, bad weather conditions, roads crossed out or any other unforeseen traffic condition.
France Travel does not accept any responsibility for any delay resulting from inaccurate or incomplete departure or arrival address submitted by the Client, or from the Client late arrival at the agreed pick-up location.
ARTICLE 9 – CUSTOMER SERVICE AND CLAIMS

Any complaint must be notified in writing at the latest 8 days after the transportation service was performed. Any dispute arising from these Terms of Sales will be submitted to the exclusive jurisdiction of the Commercial Court of Lyon.
